1. Acceptance of the Terms
By accessing and using the Boardless application, you agree to fully comply with these Terms of Use. Use of Boardless is conditioned on your express acceptance of these terms. If you do not agree with any part of these Terms, please do not use the application.
We may change these Terms at any time. Changes will be communicated through the application and/or by email. Your continued use of the service after any update means that you agree with the revised terms.
2. Description of the Application
Boardless is a mobile (iOS) job search and professional opportunity recommendation app, based on your profile. Our goal is to make it easier to match job vacancies to your resume and preferences.
The app asks you to provide your skills, professional experience, and preferences (for example, preference for startup or large company). Boardless then searches and recommends compatible job vacancies using integrations with job partners.
Boardless acts only as a technological intermediary. We are not an employment agency and we cannot guarantee the availability of job vacancies or hiring. All decisions regarding job offers are the responsibility of the hiring companies.
3. Registration and Account
To use Boardless, you must create an account by providing a valid mobile phone number for login and verification. In addition to the phone number, we ask you to provide the following personal data during initial registration:
- Full name
- City of residence (city and state)
- Years of professional experience
- Technologies, languages, and technical skills you master
- Professional preferences (for example, type of company you want to work for, remote or on-site work, desired position, and similar information)
You agree to provide true, complete, and up to date information. You are responsible for keeping your access data confidential (phone number and any verification code or password) and for any activity carried out through your account.
Do not share your access code and avoid leaving your phone number or codes in places with easy access by third parties. Boardless is not responsible for unauthorized access to your account resulting from your negligence in protecting your phone number or access code.
4. Personal Data Collected
Data collected: To provide the job matching service effectively, we collect and store the personal data you provide at registration or when you update your profile:
- Full name
- City of residence (city and state)
- Years of professional experience
- Technologies, languages, and other technical skills you inform
- Professional and work environment preferences
- Phone number (used for login and account verification)
No other personal data is collected without your consent.
We do not collect sensitive personal data such as racial origin, religious belief, political opinion, trade union membership, genetic data, biometric data, health data, or data related to sexual life. The exclusion of sensitive data helps protect your privacy in accordance with the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados, LGPD).
Purpose of collection: The data above is collected exclusively in order to select and suggest job vacancies that are compatible with your profile and professional preferences. We do not use your personal information for any other purpose, such as targeted advertising, market research, or sale of data.
Providing professional profile data is mandatory to use the application. Without this information, it is not possible to perform job matching. Providing any other non requested information is optional.
5. Purpose of Data Processing
Boardless processes your personal data exclusively to enable the search and recommendation of job vacancies that match your profile. We may use your data to:
- Search for vacancies in integrated job databases, applying filters based on your skills, experience, and preferences
- Display and notify you of matching vacancies through the app or notifications (if enabled)
- Analyze service performance in order to improve job recommendations, always in an anonymous and aggregated way, without associating results with individual users
We do not use your data for secondary commercial purposes. We do not send unsolicited marketing communications and we do not offer your data to companies that are not listed in these Terms.
All data processing described here is carried out in compliance with the legal bases provided by the LGPD, especially the consent you give when registering and the execution of the service requested by you (job search).
6. Sharing with Third Parties
To perform job matching, Boardless integrates with third party APIs specialized in job listings. Currently, these integrations are limited to the following providers:
- Himalayas
- Jobicy
- RemoteOK
- Remotive
- WeWorkRemotely
Data sharing with these partners occurs only when necessary for vacancy searches and is limited to data strictly required by the APIs, such as:
- Keywords or technologies from your professional profile
- Approximate region (based on the city you provided) and desired type of vacancy
- Professional experience (for example, junior, mid-level, or senior, according to the information you provided)
We do not share unnecessary personal information with these APIs, such as your full name or phone number, except if a specific service requires authentication, in which case we will notify you in advance.
Each integration is subject to its own privacy policies and terms of use. We recommend that you read them directly on the websites of Himalayas, Jobicy, RemoteOK, Remotive, and WeWorkRemotely.
Aside from these partners, no other company or organization receives your personal data without your express consent. In particular, we do not sell or transfer your data for marketing purposes or product sales.
7. Data Storage
Your personal data is stored on secure cloud servers. We use reliable cloud providers and, where necessary, implement encryption for data at rest and data in transit.
Our hosting solutions may be located in Brazil or in other countries that offer adequate levels of data protection. We keep your data while your account is active and for as long as necessary to comply with legal obligations.
After your account is deleted, either by you or by us (for example, due to long term inactivity or violation of these Terms), your data will be deleted or anonymized within a time frame that complies with legal requirements.
8. Security and Confidentiality
Boardless adopts appropriate administrative, technical, and physical security measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include:
- Use of encrypted connections (SSL/TLS) for data transmission between the app and our servers
- Encryption of sensitive data at rest on the servers
- Strict access control to systems, so only authorized staff can access data, with individual authentication
- Information security policies, including periodic vulnerability reviews and staff training on data confidentiality
Despite our efforts, no security system is completely impenetrable. However, we are committed to using market best practices to protect your data. All professionals who handle personal data on behalf of Boardless are bound by confidentiality obligations.
In case of a security incident that may compromise your data, we will notify the authorities and affected users in accordance with the LGPD.
9. User Rights (LGPD)
In line with the Brazilian General Data Protection Law (Lei nº 13.709/2018, LGPD), you, as the data subject, have the following rights regarding your personal data processed by Boardless:
- Confirmation of Processing: obtain confirmation on whether we process your personal data
- Access: request access to the personal information we hold about you
- Rectification: request correction or update of incomplete, inaccurate, or outdated data
- Anonymization, Blocking, or Deletion: request anonymization, blocking, or deletion of unnecessary or excessive data, or data processed in violation of the law
- Portability: request the portability of your personal data to another service or product provider, when technically feasible
- Deletion: request the deletion of personal data processed with your consent, except in cases where the law requires retention (for example, data needed to comply with legal obligations)
- Information on Sharing: obtain information about public and private entities with which we share your data. In our case, this is limited to the job APIs mentioned (Himalayas, Jobicy, RemoteOK, Remotive, and WeWorkRemotely), as described in these Terms
- Withdrawal of Consent: withdraw your consent for data processing at any time. Note that withdrawing consent does not affect the legality of processing already carried out and may make it impossible to use Boardless, since some data is essential for the app to work
To exercise any of these rights, you can send an email to support@boardless.dev or use the support channels provided within the app. Please clearly specify which right you want to exercise and include information that helps identify your account (such as your phone number and name).
We will respond to your request within the legal time frames. We guarantee that you will have appropriate means to track the status of your requests related to your personal data.
10. User Obligations and Responsibilities
By using Boardless, you agree to:
- Comply with the law: use the app in a lawful, responsible way and in accordance with all applicable legislation
- Provide truthful information: keep your registration information accurate and up to date
- Maintain credential confidentiality: not share your phone number or access codes/passwords with third parties. You are responsible for any misuse of your account resulting from disclosure of your access data
- Appropriate use: not use the app for fraudulent purposes, harassment, or any illegal activity. Do not perform actions that may damage, disable, or overload the app or its servers
- Respect intellectual property: respect the copyrights and other intellectual property rights of third parties when using the app. Do not reverse engineer, decompile, or otherwise attempt to extract Boardless source code
Boardless may suspend or terminate your account if you violate these obligations or these Terms. In such cases, you will lose access to the app features, without prejudice to any legal measures that Boardless or third parties may take for damages caused.
11. Specific App Store (Apple) Terms
Boardless is available on the App Store (Apple Inc. app store) for compatible iOS devices. Apple is not a party to these Terms of Use and is not directly or indirectly involved in the provision or maintenance of the app.
Apple does not provide any guarantees regarding the operation of Boardless and is not responsible for any failures or claims related to the app. Use of Boardless on Apple devices is subject to the iOS Usage Rules and App Store policies, which you agree to follow.
The trademarks iOS, App Store, and corresponding logos are the property of Apple Inc.
12. Disclaimer of Warranties and Limitation of Liability
Boardless is provided "as is" and "as available", without warranties of any kind, either express or implied. We do not guarantee that the app will work without interruptions or errors.
Although we aim to provide accurate job recommendations, we do not guarantee the availability of vacancies or that they will result in actual hiring. All job information comes from third party websites, which we do not control. We cannot ensure the truthfulness, accuracy, or quality of this information.
Use of Boardless is at your own risk. Under no circumstances will Boardless or its partners be liable for indirect, special, incidental, or consequential damages resulting from the use or inability to use the app, including loss of profits, business interruption, or loss of data.
Our total liability for any claims related to these Terms is limited to the amount actually received from you as payment for the service, if any, or to a symbolic amount, to the maximum extent permitted by law. These limitations do not affect any non waivable rights granted by law.
13. Changes to the Terms and the Service
We reserve the right to modify, suspend, or discontinue the Boardless app, in whole or in part, at any time, without prior notice. We may also change these Terms to adapt to legal or business changes.
When we make material changes to these Terms, we will notify you through the app and/or by email. We recommend that you review these Terms periodically. If you disagree with the changes, you must stop using the service and close your account. If you continue to use the app, this will be considered acceptance of the updated Terms.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil, in particular the Brazilian Internet Civil Framework (Marco Civil da Internet, Law no. 12.965/2014), the Civil Code, and the Brazilian General Data Protection Law (LGPD, Law no. 13.709/2018).
To resolve any disputes arising from these Terms, the parties elect the courts of Sao Paulo, State of Sao Paulo, Brazil (the city where Boardless is headquartered), with express waiver of any other jurisdiction, however privileged it may be. If you reside in another locality, the courts of your place of residence may also have jurisdiction, in cases provided for by consumer protection or other specific legislation.
